The Rental Dispute Centre: How Landlord and Tenant Cases Actually Work in Dubai

Most landlord and tenant arguments in Dubai never reach a courtroom, and the ones that do are resolved faster than the parties expect. The reason is that Dubai does not send them to the general courts.

It sends them to the Rental Dispute Settlement Centre, a specialist judicial body established under Decree No. 26 of 2013 and operating within the Dubai Land Department.

What the Centre Handles

Disputes arising from tenancy relationships over property in Dubai, including:

  • Non-payment of rent and recovery of arrears.
  • Eviction claims, including the twelve-month notice grounds.
  • Rent increase disputes, measured against the RERA rental index.
  • Security deposit disputes.
  • Maintenance obligations and who bears them.
  • Early termination and breach of tenancy terms.

It does not handle ownership disputes, off-plan disputes with developers or service charge disputes between owners and management companies. Those go elsewhere.

Ejari Decides Whether You Have a Case

This is the single most consequential practical point in this guide.

A tenancy contract that is not registered in Ejari creates immediate problems at the Centre. Registration is the evidence that the tenancy exists on the terms claimed, and an unregistered tenancy puts the party relying on it at a serious disadvantage.

For landlords, this cuts both ways. A landlord who never registered the contract may find enforcement considerably harder. For tenants, Ejari is what connects the tenancy to utilities, visas and the rent index.

Register the contract. It costs very little and it is the foundation of every remedy that follows.

The Fee

The filing fee is 3.5% of the annual rent, subject to a minimum of AED 500 and a maximum of AED 20,000.

On a tenancy at AED 90,000 a year, that is AED 3,150. It is a real cost and it is deliberately proportionate, which is part of why the Centre is used rather than avoided.

How a Case Proceeds

Conciliation first. Cases go through an amicable settlement stage, where the Centre attempts to resolve the dispute between the parties. A significant share end here, which is the point of the design.

Then first instance. If conciliation fails, the case goes to a judge for a decision. Rental cases are handled on a compressed timetable compared with ordinary civil litigation, and a first instance decision in a matter of weeks is normal rather than exceptional.

Then appeal, if available. Appeal rights depend on the value of the claim, with lower-value claims decided finally at first instance and higher-value claims appealable within a short window of the judgment. Confirm the current threshold and deadline when your judgment is issued, because the window is measured in days rather than months.

What Decides Cases

In practice, documents.

For landlords: the Ejari registration, the tenancy contract, proof of the notice served and how it was served, the rent index position where an increase is disputed, and a clear record of payments received and missed.

For tenants: the Ejari registration, payment receipts and bank records, written maintenance requests and the landlord's responses, photographs where condition is in issue, and the notice received.

The party with a contemporaneous written record generally wins the point in dispute. The party relying on what was agreed verbally generally does not.

The Notice Rules That Generate Most Cases

Two rules produce a large share of the Centre's caseload, and both are frequently misunderstood.

Rent increases are governed by the RERA rental index, and a landlord intending to increase rent must give 90 days' notice before the end of the tenancy unless the parties agree otherwise. An increase announced at renewal without that notice is routinely challenged.

Eviction on the specified statutory grounds, such as the owner's own use or sale of the property, requires 12 months' notice served through a notary public or by registered post. A WhatsApp message is not notice.

Both rules are simple, both are checkable, and ignoring either is how a landlord loses a case they would otherwise have won.
