The Developer NOC: the Small Certificate That Can Delay a Dubai Sale by Weeks
Buyer and seller agree a price. Form F is signed. The deposit is with the broker. Both sides book the trustee office.
Then the transfer date passes, because the developer has not issued the no objection certificate.
This happens constantly, and almost always because nobody started the NOC early enough or cleared what the developer was going to ask for.
What the NOC Is
The no objection certificate is the developer's written confirmation that it has no objection to the transfer of the unit to the new owner. The Dubai Land Department will not register the transfer without it.
The developer is not approving the price or the buyer. It is confirming that the unit has no outstanding obligations to the developer or the community, and that the unit is in a state where it can properly change hands.

What the Developer Checks
- Service charges paid up to date, including any current quarter or year.
- No outstanding instalments where the unit was bought off-plan and is still on a payment plan.
- Any community or district cooling arrears cleared.
- Unauthorised alterations rectified. A removed wall, an enclosed balcony or an unapproved fit-out can stop an NOC until it is restored or approved.
- Handover formalities completed, where the unit was handed over recently.
The alterations point surprises sellers most. Work done years ago by a previous owner becomes the current owner's problem at the moment of sale.

Some developers issue in days through an online portal. Others require an appointment, an inspection and a physical queue. The difference is not predictable from the developer's size, so ask early.
The Preparation That Removes the Delay
Request a service charge statement before listing. Not before transfer. Before listing. If there are arrears, you want to know while you still have time.
Ask the developer for its NOC requirements in writing. Every developer publishes them; few buyers or sellers read them until the file is rejected.
Resolve alterations early. If a previous owner enclosed the balcony, find out now what the developer requires.
Check the chiller account. District cooling providers issue their own clearances and they are frequently the forgotten item.
Build the NOC into the Form F timetable. If the developer takes ten working days and your transfer date is fourteen days away, you have four days of margin for everything else. That is not enough.

Off-Plan Resale: a Different NOC
Selling an off-plan unit before handover involves the developer more deeply. In addition to the checks above, the developer typically requires:
- A minimum percentage of the price paid before it will permit a transfer, commonly in the range of 30% to 40%, and set by the developer.
- An administration or transfer fee, often higher than a completed-unit NOC fee.
- Its own approval of the incoming buyer, with identity and compliance documentation.
These conditions are in the sale and purchase agreement. An investor buying off-plan with the intention of selling before handover should read them at the point of purchase, not at the point of sale.
