Power of Attorney for Dubai Property: How to Buy or Sell Without Being in the Country

Most overseas buyers will need one at some point. A power of attorney, or POA, authorises somebody in Dubai to sign, register and transact on your behalf, and it is what makes a purchase possible without flying in for every step.

It is also an instrument that hands another person control of an asset worth millions. Both things are true at once, and the whole craft of using one well lies in narrowing it.

What the Land Department Will Accept

For a POA to be used in a Dubai property transaction, it must be:

Notarised. Either before the Dubai Notary Public, or, if issued abroad, notarised in the country of issue and then legalised.

In Arabic, or translated. A POA in any other language requires a legal translation by a translator licensed in the UAE. The Arabic text is the operative one.

Specific. A general POA saying "manage my affairs" is routinely rejected for property registration. The Land Department expects the powers and, in most cases, the property to be identified.

The sequence is fixed, and skipping a step means starting again:

One. Sign before a notary public in your country of residence.

Two. Attest at that country's foreign ministry or equivalent competent authority.

Three. Attest at the UAE embassy or consulate in that country.

Four. Attest at the UAE Ministry of Foreign Affairs after arrival in the country.

Five. Legal translation into Arabic by a UAE-licensed legal translator.

Budget two to four weeks for the chain, longer over holiday periods. The most common failure is step three: a document attested by the foreign ministry but never taken to the UAE mission.

What a Good Property POA Says

The difference between a safe POA and a dangerous one is almost entirely in the drafting.

  • Name the property. Community, building, unit number and title deed or Oqood reference.
  • Name the powers. Sign the sale contract, pay fees, register the transfer, collect the title deed. Do not include powers you do not need.
  • Exclude what you do not intend. If the attorney is buying for you, they do not need the power to sell, mortgage or gift. Say so.
  • Set an expiry. Property POAs in Dubai are commonly issued with a validity of around two years, and a shorter one is usually better.
  • Name one attorney. Or, where more than one is named, state whether they act jointly or severally.

A POA that says "buy, sell, mortgage, lease and dispose of any property I own in the UAE" is not a convenience. It is an open cheque.

The Costs

Notarisation at the Dubai Notary Public for a property POA typically runs in the low thousands of dirhams, with legal translation charged separately and per page. Attestation abroad is charged by each authority in the chain and varies widely by country.

Revoking One

A POA does not become harmless because you stopped using it. To revoke, you execute a deed of revocation before the same authority that notarised the original, and you notify the attorney and any party who might rely on it, including the Land Department and the developer.

Do this immediately when the transaction completes or the relationship ends. An unrevoked POA sitting in somebody's drawer is the single most common route to a property being transferred without its owner's knowledge.

Safer Alternatives Worth Considering

Remote signing services. Some developers and the Land Department support remote and digital execution for parts of a transaction, which can remove the need for a POA entirely.

A lawyer as attorney. A regulated professional carries insurance, a licence to lose and a complaints regime. A friend carries none of those.

A narrow, single-transaction POA. Issue it for the specific purchase, with an expiry shortly after the expected completion date, and revoke it on completion.

Every serious POA problem in Dubai property comes from a document that was too wide, too old, or never cancelled.
